Terms of Service

These Terms of Service (“Terms”) govern your use of the Fortissimo platform (“Service”), operated by FoundersFountain (“we”, “us”). By creating an account, you agree to these Terms on behalf of yourself and your organisation.

Fortissimo is a B2B SaaS platform providing booking pipeline management, artist roster management, show advancing, contract generation, invoicing, and AI-assisted workflow tools for booking agencies.

We reserve the right to modify or discontinue features with 30 days’ notice, except where required by legal or security reasons.

You must be at least 18 years old and have authority to bind your organisation to these Terms. You are responsible for keeping your credentials secure and for all activity under your account.

Each organisation (“Agency”) on Fortissimo is a separate multi-tenant workspace. Agency admins control team access and permissions.

Plans: Fortissimo offers Starter (€149/mo), Growth (€299/mo), and Agency Pro (€599/mo) plans, with annual options at 20% discount. All plans include a 1-month free trial. Current pricing is listed at getfortissimo.com.

Billing: Subscriptions are billed monthly or annually in advance via Stripe. Payment is due at the start of each billing period.

Failed payments: If payment fails, we will attempt to collect up to three times over 7 days. Access will be suspended if payment cannot be collected.

Cancellation: You may cancel at any time via the billing portal. Cancellation takes effect at the end of the current billing period — no prorated refunds are issued for the remaining period.

Refunds: We offer a 7-day money-back guarantee on first-time subscriptions. After that, all charges are non-refundable.

Price changes: We will give 30 days’ notice before increasing prices. Continued use after the notice period constitutes acceptance.

You may not use Fortissimo to:

• Violate any applicable law or regulation
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorised access to any system
• Scrape or extract data via automated means beyond normal use
• Resell or sublicense access to the Service
• Use AI features to generate content that infringes third-party rights

You own all data you input into Fortissimo (artist info, deals, contracts, invoices). We do not claim any ownership over your data.

You grant us a limited licence to process your data solely to provide the Service. On account closure, you may export your data within 30 days of cancellation, after which it will be deleted in accordance with our Privacy Policy.

AI-powered features (Show Advancing Email Drafter, Deal Memo Generator, Smart Roster Matching) are provided as assistance tools only. You are responsible for reviewing AI-generated output before use. We do not guarantee the accuracy or fitness for purpose of AI-generated content.

Fortissimo and its original content, features, and functionality are owned by FoundersFountain and protected by intellectual property law. You may not copy, modify, or reverse engineer the platform.

We target 99.9% monthly uptime for Agency Pro plans. For Starter and Growth plans, we provide commercially reasonable availability but do not guarantee specific uptime levels. Scheduled maintenance will be communicated in advance where possible.

To the maximum extent permitted by law, Fortissimo’s total liability for any claim arising from these Terms or use of the Service is limited to the fees you paid in the 3 months preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or data loss.

You agree to indemnify and hold Fortissimo harmless from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by the laws of Germany. Disputes shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany, unless mandatory consumer protection law in your jurisdiction requires otherwise.

We will notify you by email at least 14 days before material changes to these Terms take effect. Continued use after the effective date constitutes acceptance.
